Our firm is dedicated to assisting clients at every stage of the CBSA investigative process. Drawing on our substantial and recent experience with the Canada Border Services Agency (CBSA), as well as our strong understanding of its investigative practices and procedures, we help clients pursue the best possible outcome in trade remedy proceedings.

As soon as a client receives a Request for Information (RFI), we move quickly to help them meet their business objectives. We work closely with the client to develop the strategy best suited to the facts of the case and the desired outcome, and then provide practical guidance on how to approach, organize, and present responses to each section of the RFI in a clear and efficient manner, with a view to maximizing the prospects of a favourable result while minimizing supplemental questions.

We conduct a thorough review of each response to ensure that the final submission is well organized, consistent, and free of material errors, while also ensuring that only the information necessary to respond properly to the CBSA is provided.

Following the preliminary determination, we review and analyze the CBSA’s findings and calculations to identify any material errors or issues that may affect the outcome. We also assist clients in preparing for CBSA verification, including on-site verification. As former CBSA investigators, we understand the nature of the supporting documents and evidence typically requested during that process.

Once the record is closed, we assist clients by preparing case arguments pertaining to how the CBSA should use our clients’ information and reply submissions addressing contentious issues brought by opposing counsels.

At the conclusion of the CBSA investigative process, we review the final determination and calculations to ensure that they are accurate and free of material errors that may prejudice the client’s interests.

We also arrange legal representation, through experienced affiliated Canadian law firms, for clients requiring representation before the Canadian International Trade Tribunal (CITT). These firms have demonstrated success in trade law matters and in representing clients during Tribunal hearings.

In addition, we assist clients in other CBSA proceedings, including re-investigations, administrative reviews, and expiry reviews.

We also provide support in CBSA enforcement and CITT matters, including requests for re-determination, appeals, and product exclusion requests.
